UNFAIR COMPETITION AND LAWSUITS THAT MAY BE FILED

Turkish Commercial Code  (“Code”) has introduced some regulations regarding unfair competition with the aim of to protect the interests of all participants and to provide an undistorted and honest competition environment. The Code defines that the misleading acts and commercial practices to affect the relations between competitors or between suppliers and customers or contrary to good faith are unfair and illegal. In this article, we would like to mention about unfair competition conditions and lawsuits that may be filed.

ALL ASPECTS OF THE TRADEMARK REGISTRATION PROCESS IN TÜRKİYE

The trademark is the best way to distinguish the products and services you produce from the products and services of another business. It is a fact that trademarks that catch our eye as images, texts, and/or a combination of these as logos have almost become the identity of businesses as a result of long efforts. That is why it is very important for businesses to protect their trademarks in line with the protection of commercial reputation and competition market requirements. In order for a trademark to be protected, it is stipulated in most national legal systems that the trademarks be registered in a specific registry. In Türkiye, in order to protect the trademarks, it is needed to make an application to The Turkish Patent and Trademark Office (“Türk Patent ve Marka Kurumu” and “TPMK”).

INFORMATION ABOUT THE “CE” MARKING REGULATION

In the Official Gazette dated 27 May 2021 and numbered 31493, the “CE” Mark Regulation (“Regulation”) entered into force. In this article, we will try to briefly touch on what is regulated by the Regulation, which covers the products for which the “CE” mark is envisaged, and which determines the procedures and principles regarding the placing and use of this mark.
